NEW DELHI: In a major political development, Congress leader and Leader of Opposition Rahul Gandhi has raised strong objections over the appointment of Gyanesh Kumar as India’s new Chief Election Commissioner (CEC). He alleged that the government made a “midnight decision” to select the CEC while the matter was still under judicial review.

Gyanesh Kumar, a 1988-batch IAS officer from the Kerala cadre, officially took charge as CEC on February 19, 2025. His appointment came following the retirement of Rajiv Kumar, who had been serving in the role since May 2022. Gyanesh Kumar’s tenure is set to continue until January 26, 2029. Before becoming Election Commissioner in March 2024, he held key positions, including Cooperation Secretary and Parliamentary Affairs Secretary.

Rahul Gandhi, in his dissent note, stressed that an independent Election Commission is essential for democracy and accused the government of undermining the selection process. He stated that the appointment of the CEC must be free from executive interference. The timing of the decision, he argued, raises serious concerns about the fairness and transparency of the process.

Supporting Gandhi’s position, several opposition leaders have also voiced concerns over the appointment, calling it a move that weakens democratic institutions. The Supreme Court is set to hear petitions challenging the process, which could have significant implications for future elections in India.
