Art: Bombay HC Orders Release of Souza and Padamsee Artworks

In a landmark ruling on Friday, the Bombay High Court directed Mumbai Customs to return seven confiscated artworks by prominent artists Francis N. Souza and Akbar Padamsee within two weeks. The court’s decision follows a dispute regarding the classification of the artworks as obscene, a claim that the judges dismissed, stating, “Sex and obscenity are not always synonymous.”

The case began when Mumbai businessman Mustafa Karachiwala acquired a folio of four erotic drawings by Souza, along with a drawing and two nude photographs by Padamsee, in 2022. Upon attempting to import the pieces, Customs seized them, invoking a 1964 notification and imposing a ₹50,000 fine on Karachiwala. He was also asked to explain why the artworks should not be destroyed.

Karachiwala subsequently appealed to the high court, which ruled in his favor. Justices MS Sonak and JS Jain emphasized that Customs officials cannot act as arbiters of community standards, noting that their decision reflected a narrow view of obscenity that overlooked the artists’ significance and the artworks’ artistic merit. The court highlighted that the expertise and renown of Souza and Padamsee were entirely ignored in the Customs assessment.

The judges remarked that the Assistant Commissioner of Customs demonstrated an “obsession” with his own interpretations of obscenity, failing to consider existing judicial precedents that recognize the artistic value of such works. They stressed that the classification of art should not be dictated by personal biases.

Karachiwala expressed his enthusiasm about the court’s decision, stating, “I’m excited to finally unbox the art I had acquired.” He acknowledged the support of prominent gallerists like Roshni Vadhera and Geeta Mehra, who provided guidance and certification for the artworks.

This ruling sets a significant precedent in India’s art landscape, reaffirming the importance of artistic expression over restrictive definitions of obscenity.

BJP Leader’s Controversial Remarks Ignite Political Firestorm in Sangamner

Political tensions flared in Sangamner, Maharashtra, after Bharatiya Janata Party (BJP) local leader Vasant Deshmukh made inflammatory comments about Congress leader Jayashree Thorat, daughter of senior Congress politician Balasaheb Thorat. Deshmukh’s remarks, delivered during a rally featuring former BJP MP Sujay Vikhe-Patil, sparked significant backlash, leading to protests and violent confrontations.

During his speech, Deshmukh made derogatory comments about Jayashree, questioning her character and implying she was unworthy of her father’s legacy. His comments quickly went viral on social media, provoking outrage among Congress supporters. An angry mob attacked vehicles associated with the BJP, resulting in damage and escalating tensions in the region.

In response to the incident, Congress workers organized a sit-in protest outside the local police station, demanding swift action against Deshmukh. After hours of protests, authorities eventually registered a First Information Report (FIR) against him around 5 a.m. The demonstrations continued into the following morning, with protesters calling for Deshmukh’s arrest.

Jayashree Thorat condemned Deshmukh’s remarks, stating, “His language is unbecoming of his age and position. He has made derogatory statements against a young woman, and his behavior is unacceptable. Why is he still at large?” She emphasized her resolve to confront such behavior and called for accountability.

Sujay Vikhe-Patil, while attempting to distance himself from Deshmukh’s comments, expressed regret over the incident. “I tried to intervene during his speech. His remarks were inappropriate, and I condemn them. However, I also call for action against those who vandalized our vehicles,” he said.

Additionally, Shiv Sena (UBT) MP Sanjay Raut criticized Deshmukh’s remarks, accusing the BJP of inciting communal tensions. The Nationalist Congress Party, led by Ajit Pawar, also expressed condemnation, arguing that such language undermines the political discourse in the region.

As the situation develops, both parties are facing pressure to address the escalating conflict and restore peace in Sangamner.

Congress Releases Second List of Maharashtra Candidates, Highlights Nagpur South Nomination

The Congress has unveiled its second list of 23 candidates for the Maharashtra assembly elections on November 20. The party has chosen Girish Krushnarao Pandav for the Nagpur South constituency, a seat previously contested with Shiv Sena (UBT). Suresh Bhoyar will represent the party in Kamthi.

Despite reports of tension over seat-sharing in the Maha Vikas Aghadi (MVA), Congress leaders assured the public that the alliance is unified and working toward forming the next government. Final seat-sharing details are expected to be announced soon.

CBDT Extends Income Tax Return Due Date to November 15 for AY 2024-25

NEW DELHI: The Central Board of Direct Taxes (CBDT) has extended the deadline for filing Income Tax Returns (ITR) for Assessment Year (AY) 2024-25. Originally scheduled for October 31, the new deadline is now November 15, 2024, targeting assessees who fall under clause (a) of Explanation 2 to section 139(1) of the Income-tax Act, 1961. This group typically includes corporate entities, audited individuals, and those whose accounts require auditing.

The decision, taken under section 119 of the Act, aims to provide additional compliance time for taxpayers facing last-minute technical or financial delays in their filing process. This comes in response to demands from various industries and tax professionals who were concerned about meeting the original timeline due to ongoing audit procedures and complex documentation requirements. The extension is expected to ease administrative processes and allow for accurate reporting without penalties.

The announcement is part of CBDT’s ongoing efforts to ensure smoother compliance for taxpayers amid changing financial and operational dynamics. This extension provides crucial flexibility for corporations and large entities that often need additional time to fulfill audit requirements before submitting their returns.

For taxpayers, this change offers added time to verify all required documents and optimize tax strategies, aligning with CBDT’s goal of facilitating a more streamlined and accurate reporting process.

Ind vs NZ: India in a critical mess

We are onto the 3rd day of 2nd Test at Pune, India is tangled in a situation no one expected. The hosts are asked to chase 359 runs in the final innings of the match and to stay alive in the series. New Zealand bowled out India for just 156 runs in first innings, taking the lead of 103. Kiwi batters added another 255 to their combined lead of 358 runs.

Indian batters had no clue against NZ spinner Mitchell Santner in first innings, coupled with some reckless shots pushed India into this precarious situation. Losing first test damaged India’s WTC final hunt and a loss here at Pune will worsen the situation. Batters failed to capitalize on the opportunities. Its the bowlers who challenged Kiwis until now.

Nz’s second innings followed a similar pattern to their first innings. A couple of small partnerships failing to register big, and then losing it all within a session. They were 5 wickets down at the start of day’s play, and lost 5 wickets in the morning itself. Spin trio of Ravichandran Ashwin, Ravindra Jadeja and Washington Sundar took 2,3 and 4 wickets respectively. Captain Tom Latham led the charge with his gritty 86, Tom Blundell and Glenn Phillips contributed 41 and 48 respectively.

Now that NZ innings in this match are over, the baton is passed to the batters. Poor display of batting is why India is trailing by such mammoth of a margin. Top guns- Rohit Sharma and Virat Kohli have been below average in this series.

India stands at 81-1 after 12 overs at the lunch break. Yashasvi Jaiswal 46(36) and Shubhman Gill 22(20) are at the crease. Rohit Sharma had yet another failure, getting caught in Santner’s spin web at just 8. India still has a long way despite its aggressive start. With 9 wickets and 8 session still remaining, there is nothing to hurry about. It should be matter of time if played cautiously. Players like Virat Kohli, Rishabh Pant and Sarfaraz Khan will have a big responsibility. Kohli being the most important one, needs to overcome his weakness against spinners.

If India loses this match, they cannot afford another defeat in remaining matches or else it will have to rely on results of other contenders. India slipped from favourites for 3rd consecutive time to the verge of getting knocked out in a matter of 2 matches. India can only afford a maximum of one draw and win five games to finish on a PCT of 71.05. If India wins remaining 6 games, which includes the upcoming BGT tour, it can accumulate 170 points at a commanding 74.56 PCT. Though it is very unlikely. A minimum of 2 wins with 4 draw will put them in mathematical chance relying on results of others.

India has been unbeaten on its home soil in Test for nearly a decade now. New Zealand has nearly  breached the fortress here. This match is in a delicate position. Team like India knows to perform under pressure, but recent form of its batters are the biggest challenge, and the NZ spinners on this pitch of course. New Zealand is on the verge of scripting history in India.
