Supreme Court Revives Insolvency Proceedings Against Byju’s, Questions Preferential Treatment of BCCI

New Delhi: In a major setback for Byju’s, the Supreme Court has overturned the settlement between the ed-tech company and the Board of Control for Cricket in India (BCCI), effectively reopening insolvency proceedings. The court directed that the ₹158 crore paid by Byju’s to the BCCI as part of the settlement be held in an escrow account until further review. The decision allows Byju’s creditors to approach the Committee of Creditors (CoC) for remedies under the Insolvency and Bankruptcy Code (IBC).

The case escalated when Glas Trust, a US-based creditor, raised objections, alleging that Byju’s preferentially settled with BCCI while ignoring other creditors. The Supreme Court supported Glas Trust’s claims, with Chief Justice DY Chandrachud criticizing the ed-tech company for settling a single debt while carrying ₹15,000 crore of liabilities. “Can one creditor (BCCI) walk away while the company is in such massive debt?” Chandrachud questioned, highlighting the need for a more equitable approach to creditor payments.

Byju’s legal team, led by Abhishek Manu Singhvi, defended the settlement, stating that the funds came from personal resources of Riju Raveendran, co-founder and brother of Byju Raveendran. However, Glas Trust argued that the money used in the settlement was “tainted” and could involve round-tripping.

The Supreme Court’s ruling has reignited concerns about Byju’s financial health, as the company grapples with over $1.2 billion in debt. This decision ensures that the insolvency process continues under strict oversight, leaving it up to the CoC to address all creditors’ claims, including those of BCCI.

Supreme Court Criticizes Punjab, Haryana for Failing to Curb Stubble Burning as Delhi Chokes on Pollution

New Delhi: The Supreme Court has once again pulled up the governments of Punjab and Haryana for failing to enforce stricter measures to prevent stubble burning, which continues to aggravate air pollution in Delhi and surrounding areas. During a recent hearing, the court expressed frustration over the lack of prosecutions despite clear violations of environmental laws, remarking that the Commission for Air Quality Management (CAQM) has remained largely ineffective.

A bench led by Justice A.S. Oka pointed out that neither state has taken sufficient punitive action. Justice Oka slammed the Punjab government for its failure to prosecute offenders, asking, “Why are you shy of prosecuting people?” This came after it was revealed that only nominal fines had been imposed, with no substantial legal actions initiated against violators. The court warned of contempt proceedings if both states did not comply with its directives within a week.

Haryana’s Chief Secretary, Mr. Prasad, was summoned to provide clarity on his state’s actions, but the court criticized the inconsistencies in his affidavit, which showed a gap between reported incidents of stubble burning and FIRs filed. Despite appointing over 5,000 nodal officers, the court found that real progress was missing, stating that meetings alone would not solve the problem.

Environmentalists have long warned that the seasonal practice of stubble burning, particularly in Punjab and Haryana, significantly contributes to Delhi’s hazardous air quality levels each winter. The Supreme Court made it clear that superficial penalties and administrative meetings will not suffice, urging immediate and more stringent action.

Mumbai: Sana Malik, daughter of NCP leader Nawab Malik, is set to be the NCP-AP candidate from Anushakti Nagar. This constituency, traditionally a stronghold of the Nationalist Congress Party (NCP), is held by her father Nawab Mallik.

Sana Malik’s candidacy comes amid a broader seat-sharing agreement in the Maha Yuti alliance, where NCP (Ajit Pawar faction), BJP, and Shiv Sena (Shinde faction) have collaborated to secure key constituencies. While her father, Nawab Malik, who has represented the Anushakti Nagar seat in the past, is likely to contest from the Shivajinagar-Mankhurd constituency, Sana will take over the reins in Anushakti Nagar.

However the BJP is not comfortable projecting Nawab Mallik as a candidate of the Mahayuti, said a senior leader of the party. Nawab Malik a prominent figure in Maharashtra’s politics continues to face BJP’s opposition and the BJP may force Ajit Pawar to drop his candidature.

As for Sana, her nomination is seen as part of NCP’s efforts to promote youth and women leaders, aligning with Ajit Pawar’s recent push to reserve seats for minority candidates.

If this alliance materializes, it will set up a high-profile contest between Sana Malik and Fahad Ahmed, making this constituency a closely watched one.

Pune: In a significant development, Pune Rural police seized ₹5 crore in unaccounted cash from a car during a routine check on the Mumbai-Bengaluru highway on Monday. This incident comes in the wake of the model code of conduct that was implemented in Maharashtra on October 15, ahead of the upcoming assembly elections scheduled for November 20.

The operation took place near the Khed-Shivapur plaza, where police conducted a nakabandi (checkpoint) and intercepted a vehicle traveling towards Satara. Upon searching the car, officers discovered the substantial cash amount concealed within, prompting immediate counting by both police and district election officials. An investigation into the source of the funds is currently underway, with police officials emphasizing the importance of transparency during the electoral process.

Shiv Sena (UBT) leader Sanjay Raut has alleged that this seizure is just the tip of the iceberg. He claimed via a post on social media platform X that an even larger sum—₹15 crore—was seized from a vehicle belonging to a member of the Shiv Sena faction led by Maharashtra Chief Minister Eknath Shinde. Japan’s Female Participation in Politics Met With Slow Progress
